Terms of Service

1. Overview

 

Welcome to The Beauty Lair, a cosmetic tattoo studio located in Hesperia, CA. We specialize in permanent makeup and related beauty services (e.g., microblading, lip blushing) to enhance natural beauty. These Terms of Service (“Terms”) govern your use of The Beauty Lair website and any services you book or receive through us. By accessing our site or scheduling a service, you agree to these Terms. If you do not agree, please do not use our site or services. We strive to provide a safe, professional experience, and these Terms help clarify mutual expectations.

 

2. Eligibility to Use Our Services

 

Our services are intended for adults who can legally consent to cosmetic tattoo procedures. You must be at least 18 years old to book or receive any permanent makeup/tattoo service at The Beauty Lair. California law prohibits providing tattoos or permanent cosmetics to minors, even with parental consent. We will verify age with a government-issued photo ID at your appointment. If you are under 18, we cannot provide service, and any appointment will be canceled. Additionally, for safety and compliance reasons:

    •    Pregnancy/Nursing: We do not perform cosmetic tattoo procedures on anyone who is pregnant or currently breastfeeding. This is a precaution for your health and the baby’s. Please wait until you are no longer nursing or have delivered and recovered before booking.

    •    Health Conditions: You must be in a suitable health condition for the procedure. It is your responsibility to inform us of any medical conditions, skin conditions (such as psoriasis or eczema in the treatment area), blood disorders, or medications that could affect the service. For certain conditions (e.g., uncontrolled diabetes, blood-borne illnesses, active skin infections, undergoing chemotherapy, use of Accutane or blood thinners), we may require a doctor’s note clearing you for the procedure or we may respectfully refuse service for your safety. This is to ensure the procedure will not adversely affect your health.

    •    Right to Refuse: We reserve the right to refuse service to anyone who does not meet our eligibility criteria or whom we deem not suitable for a cosmetic tattoo procedure. This includes clients who arrive impaired by alcohol or drugs, those with contraindicated health conditions, or those demonstrating inappropriate behavior. Our decisions are always made with safety and legal compliance in mind.

 

3. Booking and Appointment Policies

 

Appointments are required for most services at The Beauty Lair. You may request a booking through our website or by contacting us directly. When booking an appointment:

    •    Deposit: We require a non-refundable deposit to secure your appointment slot. The deposit amount and payment instructions will be provided at the time of booking. No appointment is confirmed until the deposit is received. This deposit will be applied toward the total cost of your service on the day of your appointment.

    •    Appointment Confirmation: Once your deposit is paid, you will receive a confirmation of your appointment date and time. The remaining balance for the service is due on the day of your appointment.

    •    Pre-Appointment Requirements: If you have existing permanent makeup (from another artist) in the area you want serviced, you must inform us and send a clear photo beforehand or schedule a consultation. Failure to disclose previous cosmetic tattoos may result in your appointment being canceled upon arrival if the area is not suitable for work, and your deposit may be forfeited. We need to evaluate if correction or removal is needed before we can work on it.

    •    No Guests/Children Policy: For safety and focus, only the client receiving the service is allowed in the procedure room. No children (under 18) or additional guests may accompany you into the treatment area. The procedure involves sharp tools and requires our full concentration; having extra people can be distracting and is not permitted by health regulations. Please make childcare arrangements prior to your appointment.

    •    Arrival Time: Please arrive on time for your appointment. We advise arriving 5-10 minutes early to find parking and fill any necessary paperwork. If you are running late, contact us as soon as possible. Clients more than 15 minutes late may need to be rescheduled and the deposit may be forfeited, as tardiness can affect our schedule for other clients. Consistent communication helps us accommodate you as much as possible.

    •    Client Conduct: We request that you arrive with the treatment area clean and free of makeup (for brow appointments) and that you have followed any prep instructions we provided (such as avoiding caffeine or blood thinners on the day of a microblading service). Please be respectful and maintain personal hygiene. We maintain a professional, comfortable environment and expect clients to behave respectfully towards our staff and other clients in the studio.

 

4. Cancellation and Refund Policies

 

We understand that unforeseen circumstances can arise. However, because our services are by appointment and involve preparing materials and reserving time just for you, we have the following cancellation policy:

    •    Cancellation Notice: If you need to cancel or reschedule your appointment, please notify us at least 24 hours in advance. This allows us to possibly fill your slot with another client. Cancellations or reschedule requests made with less than 24 hours’ notice may result in forfeiture of your deposit and/or a late cancellation fee.

    •    No-Show Policy: If you do not show up to your scheduled appointment and provide no notice (“no-call, no-show”), your deposit will be forfeited. We also reserve the right to charge a No-Show fee of up to 50% of the scheduled service price for the lost time. You will need to pay a new deposit if you wish to book a new appointment after a no-show. Repeated no-shows or last-minute cancellations may result in us declining to book you for future services.

    •    Rescheduling: We allow one reschedule without penalty if you give sufficient notice (24+ hours). The deposit can be transferred to the new appointment date in this case. However, frequent rescheduling or rescheduling more than once may result in an additional booking fee or require an additional deposit, at our discretion. We will work with you within reason, but please respect that our artists have reserved that time for you.

    •    Refunds on Services: All sales are final for services. We do not offer refunds for completed services (e.g., after you have received your microblading or permanent makeup application) simply because a client has a change of heart or is unhappy with the color/style they chose. Cosmetic tattooing is a process, and often a follow-up touch-up appointment (which may be included or discounted) is used to perfect the result. We will do our best to set realistic expectations and achieve agreed-upon results, but individual results will vary and are not guaranteed. Because of this variability, and since the service time and product are invested, we cannot offer refunds once the service has been provided. If there is a true issue attributable to our work (for example, a mistake on our part), we will make reasonable efforts to address it – such as a complimentary touch-up or correction – but monetary refunds are not given for services rendered.

    •    Cancellation by The Beauty Lair: In the rare event we must cancel or reschedule (due to artist illness, emergency, or other unforeseen issue), we will do our best to give you as much advance notice as possible. You may choose to reschedule or receive a refund of any deposit paid if we initiated the cancellation. We will not charge any cancellation fee in this case, and we apologize for any inconvenience.

 

5. Payment Terms and Accepted Methods

 

Payment for services is due in full by the end of your appointment (minus any deposit pre-paid). Our accepted payment methods are:

    •    Cash (USD currency) – we recommend cash for the remaining balance on the day of service if possible.

    •    Major Credit or Debit Cards – we accept Visa, MasterCard, American Express, and Discover. (Credit/Debit card payments may incur a small processing fee, approximately 3%, to cover merchant fees).

    •    Electronic Payments – we also accept certain electronic payment options such as Zelle or Venmo for your convenience. Please inquire ahead of time if you plan to use an app payment so we can provide the correct account details.

    •    No Personal Checks – we do not accept personal or business checks. All payments must be in forms that can be completed on the day of service.

 

All service pricing will be clearly communicated to you before we begin the procedure (either listed on our site or discussed during your consultation/booking). The price quoted typically covers the initial procedure and, if stated, one touch-up (for certain services) within a specified time frame. If you request additional services or significantly change the scope of work during the appointment, additional charges may apply (and will be discussed before proceeding). Sales tax is generally not applied to services, but any product purchases (aftercare kits, etc.) will include tax as required by law.

 

If your payment method fails or is declined (e.g., credit card is declined), you remain responsible for paying your balance. We may withhold any touch-up scheduling or future appointments until the balance is paid. Non-payment for services already rendered may result in legal action or debt collection efforts.

 

6. Health and Safety Disclaimers

 

Your health and safety are our top priority. We adhere to all applicable health regulations for body art establishments, including using pre-sterilized, single-use needles and high-grade pigments, practicing proper sanitation, and maintaining a clean environment. However, it is important to recognize that cosmetic tattooing (permanent makeup) involves breaking the skin, and with any such procedure there are inherent risks. By choosing to receive services at The Beauty Lair, you acknowledge and accept these risks. Key health and safety points include:

    •    Patch Testing: If you have a history of sensitivity or allergic reactions to makeup, dyes, metals, or lidocaine, please inform us. We can perform a patch test for pigment or numbing agents in advance, upon request. Note that patch tests are not guaranteed to predict all reactions; traces of metals (like nickel) in some pigments or needles could potentially cause reactions that a patch test might not catch. An absence of reaction in a patch test does not ensure you won’t have a reaction during or after the full procedure. You agree that we cannot be held liable for allergic reactions or sensitivities that were not detected by a patch test.

    •    Client Medical Responsibility: You affirm that you do not have any condition that is contraindicated for cosmetic tattooing (unless you have clearance from a physician). Contraindications can include: pregnancy, nursing, uncontrolled diabetes, active infection (like cold sores for lip blush or conjunctivitis for eyeliner), blood-borne diseases (HIV, hepatitis), bleeding disorders, or if you are on certain medications (e.g., strong blood thinners, Accutane). If you have any doubt, please consult with your doctor before your appointment. We may ask you to sign a health intake or consent form confirming these statements. If you neglect to disclose a known condition or contraindication and we discover it at the appointment, we may refuse to proceed and your deposit will be forfeited. This is for your own safety.

    •    Sterilization and Hygiene: Our artist will open new, sterile needle cartridges and use sterile, single-use supplies in your presence. We follow strict procedures for hygiene and cross-contamination prevention throughout the service. Do not touch any of the procedural tools or supplies to avoid contamination. We ask that you also keep your phone put away during the procedure, and avoid touching the treated area with your hands.

    •    Aftercare is Essential: After your procedure, we will provide you with written and/or verbal aftercare instructions. Following these instructions is paramount to proper healing and results. If you do not follow the provided aftercare guidelines, you significantly increase the risk of infection, pigment loss, or other complications. We are not responsible for issues that arise from negligence in aftercare. For example, if you go against advice by submerging the treated area in water (pools, ocean) or applying unapproved products and an infection results, that is outside our control. By receiving our service, you agree to care for your tattooed area as instructed.

    •    Possible Side Effects/Risks: Common side effects after a cosmetic tattoo procedure include temporary redness, swelling, tenderness, or minor bruising around the area. These typically subside in a few hours to a couple of days. However, there are less common risks such as infection or allergic reaction. Signs of infection can include excessive swelling, pus, severe pain, or fever. If you suspect you are developing an infection or any other complication, seek medical attention promptly. We do not provide medical treatment; any advice we give on care is not medical advice (see Disclaimers). We maintain that we use sterile techniques and high-quality products, but you assume the risk of these inherent possibilities when undergoing the procedure.

    •    Client Acknowledgement: Prior to your procedure, you will be asked to sign a consent form acknowledging these risks and confirming that you have provided a truthful medical history. You will also confirm that all your questions have been answered to your satisfaction. We cannot proceed without a signed consent. At that time, you affirm you are voluntarily choosing to undergo the cosmetic tattoo service, and release The Beauty Lair and our technicians from liability for any adverse reactions or outcomes beyond our control, as long as we have followed proper procedures and the Terms herein.

    •    Touch-Up Policy: Many permanent makeup procedures are a two-step process: an initial session and a follow-up touch-up (perfecting session) about 4-8 weeks later. If a touch-up is included or offered at a discounted rate, that will be communicated. It is your responsibility to book your touch-up within the recommended time frame. Touch-ups scheduled after the window may incur additional cost. Note that how well the pigment retains can depend on your skin and aftercare – some clients may need an extra session if their skin did not retain pigment well or if aftercare was not followed. Additional sessions beyond the included touch-up, if needed, will be charged accordingly. This is not considered a “free correction,” but rather an additional service due to individual variation or lifestyle (e.g., smoking, sun exposure can fade cosmetic tattoos faster).

    •    Covid-19 / Illness: If you are experiencing any contagious illness (flu, cold, COVID-19 symptoms, etc.), please reschedule your appointment for when you are well. This is to protect our staff and other clients. We will do the same and reschedule you if your artist is ill. There is no penalty for rescheduling due to genuine illness; just let us know as soon as possible.

 

By adhering to these health and safety policies, we can ensure a smoother experience and better results for your service. 7. Intellectual Property Rights

 

All content on The Beauty Lair website – including text, graphics, logos, images, audio clips, and software – is the exclusive property of The Beauty Lair (or our content suppliers) and is protected by intellectual property laws. This includes our business name and logo, which are protected trademarks. You may not reproduce, distribute, modify, or create derivative works from our website content for any public or commercial purpose without our express written permission. You are welcome to read, share links to our site, or print pages for personal use, but any other use (such as copying our portfolio photos or text to use on your own site) is prohibited.

 

Client Photos and Artwork: We retain intellectual property rights in the images of our work. For example, if we take before-and-after photos of your treatment, those photographs are our property (we took them) and we may use them as described in the Social Media section. We also own any designs or drawings we create as part of providing your service. You may of course wear and enjoy the results (the actual appearance of the microblading on your face is yours!), but you cannot claim the design or image as your own creation or use it for commercial gain (for instance, you can’t sell our eyebrow design as a logo or use our photos to advertise your own business).

 

If you submit any content to us (such as testimonials, feedback, or comments), you grant The Beauty Lair a license to use that content in any manner necessary to operate our business. For example, if you email us a thank-you note and before/after picture and give permission, we might share it on our site or social media. We will never sell your personal content, and any such use would typically be anonymized or first-name-only unless you’ve stated otherwise.

 

8. Social Media and Client Content Usage

 

The Beauty Lair maintains an active presence on social media (e.g., Instagram, Facebook) to showcase our work and educate clients. We respect our clients’ privacy while also celebrating the great results we achieve together. By receiving services at The Beauty Lair, you acknowledge and agree to the following regarding photos and media:

    •    Photography/Videography of Services: We may ask to take photographs of the treatment area before, during, and after your procedure. These photos help document the transformation and are useful for both client records and marketing. We will never photograph your face in a way that identifies you without permission; typically, permanent makeup photos focus on the treated area (e.g., just the eyebrows or lips). We make efforts to crop or conceal identifying features if used publicly. By accepting our services, you grant us permission to take such photos/videos and to use them for our business purposes, including posting on our website, in our portfolio, or on social media platforms. This also includes use in other marketing materials (like brochures or future advertising). If you have strong reservations about this, please inform us before or during your appointment, and we will accommodate by not using your particular photos publicly. Our default assumption, however, is that we may respectfully showcase the work.

    •    Usage of Client Likeness: Any images shared will typically not include your name or personal details, unless you’ve explicitly agreed to be tagged or identified (for instance, if you participate in a testimonial). Usually, we might caption a photo as “#microblading transformation – before and after!” without naming the client. If we’d like to feature a testimonial from you with your name or share a post where you’re identified, we will obtain your consent.

    •    Social Media Tagging and Reposting: We love when clients are happy and share their results on social media. If you tag us or hashtag our business, we may reshare your post or story on our own social media. By tagging us publicly, you are implying consent that we can repost that content. We will credit you by username when reposting. If for any reason you prefer we not share something you posted, just let us know and we will take it down.

    •    No Compensation: You understand that you will not receive any financial compensation for the use of photographs or videos of your procedure/results in our marketing. The exchange is that you get a beautiful service and we get to display the artistry.

    •    Client Content Moderation: If our website eventually allows reviews or comments, any content you or other users post must be respectful and lawful. We reserve the right to remove or moderate comments on our website or social pages that are inappropriate, offensive, or violate others’ rights. We also reserve the right to use or delete any reviews or testimonials at our discretion (we won’t alter your words, but we might choose to showcase or not showcase them).

 

We truly appreciate being able to share our work and find that most clients enjoy seeing their results featured. It helps others in deciding about services and lets us be proud of the work. We will always approach this usage with respect and sensitivity to your privacy.

 

9. Governing Law and Dispute Resolution

 

This agreement and any services provided by The Beauty Lair are governed by the laws of the State of California, without regard to its conflict of law principles. We are a California-based business and operate under California law. If a dispute arises between you and The Beauty Lair regarding these Terms or our services, we encourage you to contact us directly to seek an amicable resolution.

 

In the event a dispute cannot be resolved informally, you agree that any legal claim or action will be brought exclusively in the state courts of San Bernardino County, California or the federal courts of the Central District of California, as appropriate. You consent to personal jurisdiction in these courts and waive any objections on the grounds of venue or inconvenient forum.

 

Dispute Process: Before filing any legal action, please give us the opportunity to address your concerns. You can do so by sending a written notice to our business email or mailing address describing the issue and what you seek. We will in good faith attempt to resolve the matter. If we cannot, then you may proceed with legal remedies.

 

Both parties agree to bear their own attorneys’ fees and costs in any dispute unless a law provides otherwise. In any dispute, our liability to you will be limited as described in the Disclaimers and Limitations (we will not be responsible for large damages beyond the cost of the service, etc.). This section does not strip you of any protections under consumer laws; it mainly clarifies venue and governing law.

 

Should any provision of these Terms be found invalid or unenforceable by a court, that provision will be severed to the minimum extent necessary, and the remainder of the Terms will remain in full effect. Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or of any of our rights.
